These Terms & Conditions (“Terms”) govern your access to and use of the eva app and website (together, the “Service”), operated by Parentology (“eva”, “we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

eva is intended for use by teenage girls and young women. If you are under the age of majority in your jurisdiction, you should use eva with the awareness and, where required by applicable law, the consent of a parent or legal guardian. By using eva, you represent that you meet these requirements or are using the Service with appropriate consent.

2. Description of the service

eva helps you track your menstrual cycle, mood, and related wellbeing information, and offers eva Buddy (a conversational AI companion) and eva Expert (an AI-powered health-information feature). Features may be added, changed, or removed over time.

3. Not medical advice

eva, including eva Buddy and eva Expert, does not provide medical diagnoses and is not a substitute for professional medical, psychological, or emergency care. Information provided through the Service — including AI-generated responses — is for general informational and educational purposes only. Always seek the advice of a qualified healthcare provider, or a trusted adult, with any questions you may have regarding a medical or mental-health condition. Never disregard professional medical advice or delay seeking it because of something you read or were told through eva.

4. AI-generated content

eva Buddy and eva Expert use artificial intelligence to generate conversational responses. AI-generated content may occasionally be inaccurate, incomplete, or inappropriate despite our efforts to guide and monitor it. You should not rely on AI-generated content as a substitute for professional advice, and you should use your own judgment when acting on anything eva tells you.

5. Emergencies and crisis situations

eva is not an emergency service and is not monitored by human staff in real time. If you are in immediate danger, experiencing a medical emergency, or having thoughts of harming yourself or others, please contact local emergency services or a crisis helpline immediately, and reach out to a trusted adult. Certain messages may trigger automated safety features that display crisis-support resources, but you should not rely on eva as your primary or sole source of support in a crisis.

6. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly if you become aware of any unauthorized use of your account.

7. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose, or in a way that could harm, disable, or impair the Service.
  • Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems.
  • Use automated means (bots, scrapers, etc.) to access or interact with the Service without our permission.
  • Submit content that is unlawful, abusive, harassing, or that infringes another person's rights.
  • Attempt to misuse eva Buddy or eva Expert to generate harmful content, including content that facilitates self-harm or harm to others.

8. Your content

You retain ownership of the information and content you submit to eva (such as journal entries and messages). By submitting content, you grant us a license to use, store, and process it as necessary to operate and improve the Service, consistent with our Privacy Policy.

9. Intellectual property

The Service, including its design, text, graphics, and underlying software, is owned by Parentology or its licensors and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works based on the Service.

10. Third-party services

The Service relies on third-party providers (including AI, hosting, and communication providers) to operate. We are not responsible for the availability or performance of third-party services outside our control.

11. Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

12. Limitation of liability

To the fullest extent permitted by law, Parentology and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

13. Termination

We may suspend or terminate your access to the Service at any time, including for violation of these Terms. You may stop using the Service and request deletion of your account at any time by contacting us.

14. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws applicable in the jurisdiction in which Parentology operates, without regard to conflict-of-law principles, except where local consumer protection laws in your jurisdiction require otherwise.
